March 2012 Home Sales Stats are Now Available
Important Notice for All MLS Users: The Fusion MLS cut over will be delayed until further notice. 
The Fusion add/edit module, which allows the entry of listings into the MLS system, was not completed as needed and we were not comfortable with releasing it to our users. CoreLogic, our Fusion vendor, will continue working to develop the add/edit module which we expect to be complete in the near future. Once the module is complete and has been fully tested, the MLS cutover to Fusion will be rescheduled, and all users will be notified accordingly.  This is a great opportunity to take advantage of a little extra time to learn the new Fusion MLS system—and to attend more classes, if needed.

If you are, your OREC CE requirements have changed! NAR: Don’t Apply QRM Mistake to QM
The Consumer Financial Protection Bureau (CFPB) risks making the same mistake with the upcoming Qualified Mortgage (QM) rule as regulators did in their proposed qualified residential mortgage (QRM) rule by setting QM's "ability to repay" standards too narrowly, NAR says in a coalition letter. The concern is that borrowers would have to put down too much money, and meet overly strict credit standards to meet the QM rule’s "ability to repay" standard. The proposed QRM rule, which received a lot of attention last year, sets underwriting standards for loans that would be included in mortgage-backed securities for sale to investors, while the QM rule creates a more general "ability to repay" standard. Expanded RESPA/TILA Rule Process Needed
NAR and other groups told the Consumer Financial Protection Bureau (CFPB) that the process for harmonizing RESPA and TILA needs to be expanded because the process represents a major regulatory effort that could impact earlier reforms to the Real Estate Settlement Procedures Act (RESPA). TILA stands for the Truth in Lending Act, and the two have overlapping requirements.

RU Graduate Degree Program Open for Business
REALTOR® University launched its first Master of Real Estate course February 27. The second session begins April 30 with two courses:  Real Estate Law and Real Estate Valuation. The Master of Real Estate degree curriculum emphasizes practical skills and concepts the real estate industry demands from real estate professionals and blends theory with real-world applications. Four eight-week sessions remain in 2012. The first 40 students in the Master of Real Estate program this year will receive a $2,500 grant. This will be distributed as $500 per course. NAR Applauds FHFA for Short Sale Directive
Fannie Mae and Freddie Mac have been directed by their regulator, the Federal Housing Finance Agency, to require servicers to acknowledge receipt of short sale purchase offers within three business days, respond to the short sale request within 30 days (with possible extension), and make a decision within 60 days of purchase offer. "REALTORS® are appreciative of efforts to speed lender responses and improve the short sale process, and hope that these new guidelines will help bring relief to distressed homeowners," says NAR President Moe Veissi.
NAR: "Ability to Pay” QM Definition too Narrow
The federal government is defining the "ability to repay" standard in upcoming rules for a qualified mortgage (QM) too narrowly, NAR tells the Consumer Financial Protection Bureau in a letter it sent jointly with other organizations. The narrow definition could drive borrowers into non-qualified mortgages, which would be far more costly and hurt households’ ability to buy.

GOVERNMENT ISSUES/LEGAL:
Federal Judge Agrees with NAR on EPA Overreach
The U.S. Environmental Protection Agency overstepped its authority last year when it vetoed a Clean Water Act permit for a mountaintop-removal coal mining project in West Virginia, U.S. District Court Judge Amy Berman has ruled. The ruling is consistent with the view of NAR, which joined other groups in an amicus brief saying EPA doesn’t have authority to veto a permit  issued by the U.S. Army Corps of Engineers, and that its own analysts had previously reviewed.
Rentals OK Given Market Conditions, Fed Says
Banks should strive to sell their REO properties on their books as quickly and smoothly as possible and use qualified, experienced professionals with local market knowledge in that process but it’s also okay to use some of the properties as rentals given today’s extraordinary market conditions, the Federal Reserve says in a policy statement it’s just released. NAR has said in statements to banking regulators that REO-to-rental programs should proceed only with caution to enable markets to recover appropriately, and also to help ensure the focus remains on keeping households in their homes as homeowners.
FCC Adopts ‘Robocall’ Rules
The Federal Communications Commission has synchronized its rules on “robocalls” with those of the Federal Trade Commission. "Robocalls" are autodialed and prerecorded calls. And the synchronized rules prohibit telemarketing, or sales, robocalls to residential subscribers without first obtaining the express written consent of the recipient. More.

REALTOR® Magazine will be hosting NAR Associate General Counsel Ralph Holmen and Senior Counsel Finley Maxson as they walk you through six significant cases last year and how they impact the practice of real estate for those in the impacted state. Although the state cases impact only what goes on within their borders, knowing what’s happening in other states can give you a head’s up on issues that may impact your state soon. The U.S. Supreme Court’s EPA permitting case, which was just decided in favor of home owners trying to build a house in a developed subdivision, will also be looked at.
