We’ll provide you with a “real” breakfast starting at 8:30 a.m., then along with your fellow thought leaders, we will dive into several scenarios describing multiple future worlds, exploring and discussing insights and implications for you, your business, our industry, and beyond. GOVERNMENT/LEGAL ISSUES:
FHA Taking Steps to Shore-up Finances
FHA is striving to shore up its finances while continuing to play its vital role in keeping financing available while the mortgage market recovers, FHA Commissioner Carole Galante told the House Financial Services Committee last week. Back in November, an independent actuarial report projected the economic value of the FHA fund to be negative $16.3 billion even though FHA has more than $30 billion to pay claims on losses. The shortfall stems from a requirement by Congress that the agency hold 30 years worth of reserves.
Clarity Sought on E-mail Signatures
(From NAR) A sales associate claims e-mail exchanges she had with a household she had been working with for months constituted an electronically signed representation agreement and so she believes she was entitled to commissions on the purchase of a property the household bought with the help of another practitioner. The household had signed the representation agreement and sent it to the sales associate, but the sales associate never signed it. But she did acknowledge receipt of the signed agreement and thanked the household for sending it to her. The trial court said that, without the associate's signature, the agreement wasn't valid, but the Court of Appeals of Arizona, Division 1, reversed the trial court and sent the case back for further proceedings to answer the question of whether the e-mails constituted an electronically signed agreement.
