Professional Standards Seminar: Enforcing the Code and Its Standards
Are you a REALTOR® member Interested in serving on GTAR’s Grievance or Professional Standards Committee? Through lecture, discussion, and case studies, Bruce Aydt, attorney and REALTOR®, will teach the concepts of professional conduct related to the REALTOR® Code of Ethics and its enforcement processes. Broker in Charge Course
If your license type is Broker Manager (BM), Proprietor Broker (BP), or Branch Broker (BB), even if only for ONE day during that license term, your OREC CE requirements are no longer the same as those of a sales associate (SA) or broker associate (BA). From now on, to renew your real estate license, you will be required to complete an OREC approved 15-hour Broker in Charge (BIC) class PLUS an additional 6 hours of required subject matter in at least two core courses (BRA, PSC, FHR or HOT). Whether you are a one-person office or a gazillion-person office, residential or commercial—this requirement applies to you!  Class is 8:30 a.m.-5:00 p.m. both days; cost is $90; class size is limited to 15. GOVERNMENT ISSUES/LEGAL:
Bureau Proposes Sweeping HUD-1, GFE Changes
The Consumer Financial Protection Bureau (CFPB) has proposed wholesale changes to the forms used in residential real estate closings. NAR is still analyzing the 1,100-page proposal. Among other things, CFPB is proposing revamping the HUD-1 Settlement Statement, Good Faith Estimate, and Truth in Lending disclosure form. Changes are also proposed to the APR, what and how items are disclosed, and when an initial disclosure must be issued. Public comments are due November 7. More.

NAR Seeks Cooperation on Rural Eligibility
NAR asked leaders of two House committees to work together to prevent rural communities from losing eligibility for Rural Housing Services loan programs. Some rural communities are at eligibility risk because of growth in nearby metro areas. The definition of rural communities hasn’t been changed in decades and needs to be updated as metro area growth encroaches on rural communities. More.

President Obama signed a $109 billion reauthorization for transportation programs in the same legislation that reauthorized federal flood insurance two weeks ago. How to Talk About the 3.8% Sales Tax Rumor
Much of the information circulating on the Internet is grossly inaccurate – the tax is not a transfer tax and it will not be imposed on all real estate transactions.  The new tax will apply to high-income households and their “unearned” investment income, including capital gains, dividends, interest, and rents minus expenses.   The 3.8 percent tax will take effect beginning January 1, 2013.   For more talking points click here.

GOVERNMENT ISSUES/LEGAL:
NAR: Broad QM Is Critical for Housing Finance
NAR urged Congress and the Administration to develop a broadly-defined Qualified Mortgage (QM) regulation. The QM regulation is designed to ensure that lenders only make loans to borrowers who have the ability to repay the loan. If the QM regulation is too narrowly defined, it could threaten the burgeoning housing and economic recovery by denying creditworthy borrowers access to safe, quality loan products, said NAR’s 2012 Vice President and Liaison to Government Affairs Scott Louser in testimony before Congress today. Flood Insurance Program Reauthorized
NAR applauds Congress for passing a five-year reauthorization of the National Flood Insurance Program (NFIP). The Biggert-Waters Flood Insurance Reform Act of 2012 was passed late last week as part of a transportation funding bill and signed into law by the president last week. The legislation extends NFIP authority through Sept. 30, 2017.
Bidders Selected for Fannie REO Pilot Program
On July 3, the FHFA announced it had made selections of bidders in the first pilot program under its REO-to-Rental initiative. A final announcement of the winning bids will be made when transactions are ready to close, expected in the next several weeks. NAR continues to communicate with FHFA on the need to insure that bids that will undermine local housing market recovery are not accepted.  FHFA made that commitment in a Feb. 29 meeting with NAR leaders and has repeated the commitment publicly on several occasions.

GOVERNMENT ISSUES/LEGAL:
Big Win: 5-Year Flood Insurance Reauthorization
After years of effort by REALTORS® to secure long-term reauthorization of the National Flood Insurance Program (NFIP), the House and Senate on Friday, June 29, passed the Biggert-Waters Flood Insurance Reform Act of 2012 as a part of H.R. 4348, the Surface Transportation Conference Report. The President is expected to sign the measure this week. This is the culmination of a multiyear campaign by REALTORS® involving five calls for Action since 2008 and a final push at NAR’s Midyear Legislative Meetings & Trade Expo in May, which included the Rally to Protect the American Dream on the National Mall in Washington. Congress had been extending the flood insurance program a few months at a time since 2008. Twice this led to shut downs, including one that stalled more than 40,000 home sales in June 2010 alone. Passage of this 5-year reauthorization will bring certainty to real estate transactions in more than 21,000 communities nationwide where flood insurance is required for a mortgage. The bill ensures the program will continue long-term for the more than 5.6 million businesses and homeowners that rely on it, and it achieves one of NAR’s top legislative priorities for the year. It also means taxpayers will spend less on federal assistance for flood disasters over the long run. NAR will continue to monitor the legislation as it is implemented.
Strong Appraisal Industry Called Key
Maintaining accurate appraisals is critical to improving market performance, appraiser Frank Gregoire told Congress last week in testimony on behalf of NAR.
